However, the promulgated law does not mandate the court to conduct the interview.

In regards to a child getting to choose where the child wants to reside, the family code now has promulgated law where you’re able to request the court to have a child interviewed.

Once the child reaches the age of 12, the child can be interviewed as to where the child would want to primarily reside.

There is a new provision that’s been inserted into the family code as well that allows for you to contact the court for the child to be interviewed for possession and access.

However, it’s not a “shall” by the court, but more of a “may”.

That means that the court does not have to interview your child in regards to it. Whether or not your child wants to have possession and access with one of the parents or more possession and access or less possession access with one of the parents or the other.
