What does possession Standard and extended standards look like since school is out until at least May 15 in FWISD and Indefinitely in Dallas ISD? 
 
Many custody schedules are in place across the Dallas Fort Worth Metroplex. With these indefinite shutdowns, many questions have arisen. Among who does the child stay with during this time.  
 
As of now, there has been a Seventh Amended Order put out by the Texas Supreme Court and it is our understanding that possession and access, commonly referred to as visitation, has not changed and that all parties that have a possession and access order should follow that order and follow the school schedule as though school is still in place. While we cannot provide a definite answer on this, as right now the situation is fluid, we are advising all clients to please attempt to co-parent in good faith and to follow the orders as they exist until we are told otherwise.

Am I still able to get Divorced during the “Shelter-in-Place” or “Stay-at-Home” orders?

During this pandemic life does not just stop. Many people have reached out asking if it is still possible to get divorced during this time. Though many courts are closed to only extraordinary situations, it is still possible to get a divorce. 

You can still get divorced while there is a “Shelter in Place” or “Stay at Home” order. As a matter of fact, deferring to file for divorce may only prolong your staying married, as you must wait at least 60 days from the date you file for the divorce to even have an opportunity to finalize your case. This does not mean your case has to be finished within 60 days or that it will be finished within 60 days, but if there is an agreement, and everything goes smooth, then you may actually be able to get your case finalized within a few days after the 60 days from the date of filing the petition expires.
