Child Support Attorney in Fort Worth, TX

Child support is one of the issues to be resolved in a divorce, child custody, or paternity case. You will either be ordered to pay or receive child support. Supporting your child financially is one of the obligations imposed upon a parent. Either way, our child support attorneys in Fort Worth can help you do what’s best for your child.

The non-custodial parent is ordered to pay child support to the custodial parent. Courts do not have wide discretion in determining the amount of child support to order because the Court must follow the Texas statutory formula.

The child support attorneys at Turner-Monahan, PLLC, will work diligently for you to ensure your child is properly taken care of. (Texas Family Code – Chapter 154. Child Support)

Determining Child Support Payments and Payment Periods

Parents are legally required to provide child support until the children reach 18 years old or until they graduate from high school. It may be extended if the child is disabled. Regardless of your child custody concerns, our child support attorneys in Fort Worth can walk you through them.

Child support for children of divorce can be paid periodically, in a lump-sum payment, through annuity purchase, or through administration property by the parent who doesn’t have primary or sole custody. The payment setup can be combined depending on the settlement.

Texas has a statutory formula that calculates the amount. It takes these factors into consideration:

  • The net monthly income of the obligor parent
  • The number of children who need support
  • The number of other children that the obligor parent pays child support for
  • The total amount of health insurance that the obligor parent pays for
  • The court will also consider the age and needs of the child, the non-custodial parent’s travel cost and time of access to the child, higher education expenses, and any type of spousal support already being paid.

The calculation based on these factors will determine the amount that the non-custodial parent is required to pay for child support. This is the default amount unless both parties agree to another amount. Either way, our child support lawyers can assist with your case.

Modifying Child Support

Once the court renders an order, there is only a limited number of circumstances wherein you can request the modification of support obligations. Generally, however, you’re entitled to review and modify a child support order three years after it is signed. Turner-Monahan, PLLC, will help you go over it.

Our child support attorneys in Fort Worth will also help you determine whether you’re entitled to a modification of support payments, even if it has been less than three years since the order was signed. We’ll review any material and substantial changes in your circumstances that may affect child support.

You may come to our child support lawyers for modification inquiries related to changes in income, education and daycare expenses, and children with special needs. Our legal team can also accommodate your concerns if you’re fighting for the right to have your children live with you.

Enforcement of Child Support

Enforcing is one of the major issues in the years following a divorce or child custody case. If one of the parents is not paying or cannot pay their child’s support obligation, the other parent has legal remedies.

Our child support lawyers in Fort Worth are dedicated to fighting for your rights and ensuring your child is getting the support he/she deserves. (Texas Family Code Sec. 154.307. Modification and Enforcement)

The child support attorneys at Turner-Monahan, PLLC have extensive experience in defending clients that are obligated to pay support and in which enforcement has been filed against them. Under the Texas Family Code, enforcement of child support allows for the obligee or the Attorney General to request that an obligor be held in contempt, fined, and even jailed for non-payment.

If you have enforcement filed against you, contact the law offices of Turner-Monahan, PLLC, as soon as you are served, or you become aware of enforcement so we may discuss with you and defend your rights.
